Granting the Kane County Sheriff and the Kane County State’s Attorney Authority to Enter into an Intergovernmental Agreement with Kendall County and a Lease with the Kane County Bar Association for Wellness Coordinator Services on Behalf of Kane County

WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that "units of local government and school districts may contract or otherwise associate among themselves . . . [and] with individuals, associations, and corporations in any manner not prohibited by law or by ordinance"; and

 

WHEREAS, Kane County, in order to promote the public's safety and welfare, wishes to assist its law enforcement agencies in accessing mental health resources, including counselors or therapists; and

 

WHEREAS, the Kane County Board has the authority to "impose additional duties, powers and functions upon county officers" (55 ILCS 5/5-1087); and

 

WHEREAS, the Kane County Sheriff is required to provide mental health resources to its employees by statute (55 ILCS 5/3-6012.2; 50 ILCS 705/6(f)); and

 

WHEREAS, the Kane County State’s Attorney desires to provide mental health resources to its employees (see 55 ILCS 5/3-9006); and

 

WHEREAS, the Kane County Board recognizes that the Kane County Sheriff and the Kane County State’s Attorney, as the elected officials responsible for the operations of their respective offices, are the county officers best situated to determine if and when it is appropriate to enter into agreements related to sharing the services of a wellness program coordinator; and

 

WHEREAS, the Kane County Bar Association (”KCBA”) has agreed to lease office space to the Kane County Sheriff and the Kane County State’s Attorney for the purpose of providing mental health services, at no cost; and

 

WHEREAS, the Kane County Board has received, reviewed, and now approves of the Intergovernmental Services Agreement Between the County of Kane, Illinois and the County of Kendall, Illinois for Sharing the Services of a Wellness Program Coordinator, attached as Exhibit A, which details how the Kane County Sheriff, the Kendall County Sheriff, and the Kane County State’s Attorney will jointly provide for the services of a wellness program coordinator for their employees; and

 

WHEREAS, the Kane County Board has also received, reviewed, and now approves of the lease agreement between KCBA, the Kane County Sheriff, and the Kane County State’s Attorney, attached as Exhibit B, subject to the review and advisement of the Office of the Kane County State’s Attorney.

 

NOW, THEREFORE, BE IT RESOLVED that the Kane County Board hereby grants the Kane County Sheriff and the Kane County State’s Attorney the authority to enter into an agreement with the Kendall County Sheriff’s Office for the shared services of a wellness program coordinator without further action by the Kane County Board, and the authority to bind the County, provided the agreement executed by the Kane County Sheriff substantially complies with the Intergovernmental Services Agreement Between the County of Kane, Illinois and the County of Kendall, Illinois for Sharing the Services of a Wellness Program Coordinator, attached as Exhibit A, and the term of any such agreement does not exceed one (1) calendar year.

 

NOW, THEREFORE, BE IT ALSO RESOLVED that the Kane County Board hereby grants the Kane County Sheriff and the Kane County State’s Attorney the authority to enter into a lease agreement with the KCBA to lease office space for the purpose of providing mental health services, attached as Exhibit B, subject to the review and advisement of the Office of the Kane County State’s Attorney, for a term of one (1) calendar year. 

 

NOW, THEREFORE, BE IT FURTHER RESOLVED that the authority herein granted to the Kane County Sheriff and the Kane County State’s Attorney will continue for two years after the date of adoption ("Termination Date"). The County Board may extend the authority every two years thereafter, by a majority vote. The County Board may revoke the authority granted to the Kane County Sheriff and the Kane County State’s Attorney at any time, with a majority vote of the County Board.
