Amending the Kane County Code to Prohibit Parking on Red Haw Lane from Thornwood Drive to Thornapple Road in St. Charles Township

WHEREAS, Section 5-1049 of the Illinois Counties Code (55 ILCS 5/5-1049) authorizes counties to exercise powers related to roads, bridges, and highways within the county; and
WHEREAS, the Kane County Board has adopted ordinances governing traffic regulation and the use of public rights-of-way within the unincorporated areas of Kane County; and
WHEREAS, the Kane County Code authorizes the County Board to regulate parking on county highways and township roads where necessary to promote traffic safety, preserve the roadway, and ensure the free flow of emergency and service vehicles; and
WHEREAS, the Township Highway Commissioner for St. Charles Township has jurisdiction over the maintenance and operation of township roads within St. Charles Township; and
WHEREAS, the St. Charles Township Highway Commissioner has requested the establishment of a parking prohibition along certain portion of Red Haw Lane due to safety concerns and right-of-way management considerations; and
WHEREAS, parking along Red Haw Lane between Thornwood Drive and Thornapple Road interferes with safe traffic movement, maintenance operations, and emergency vehicle access; and
WHEREAS, the Kane County Board finds that prohibiting parking along this roadway segment is necessary and in the best interest of public safety and the orderly use of the public right-of-way.
NOW, THEREFORE, BE IT ORDAINED by the Kane County Board that the Kane County Code, Chapter 21 (Traffic), Article I (In General), Section 21-5 (No Parking) is hereby amended, effective the date of passing, to include the following no parking restriction (insertions underlined):
