Approving a Grade Separation Agreement and Permanent Easement Deed with the Chicago Central & Pacific Railroad (CC&P) for the Randall Road at Hopps Road Intersection Improvement and Grade Separation Project, Kane County Section No. 19-00511-00-CH

WHEREAS, the County of Kane, through the Kane County Division of Transportation (KDOT), is undertaking the Randall Road at Hopps Road Intersection Improvement and Grade Separation Project, Kane County Section No. 19-00511-00-CH (the “Project”); and

 

WHEREAS, the Project includes the construction of a roadway overpass carrying Randall Road over the Chicago Central & Pacific Railroad crossing located within the Village of South Elgin, Kane County, Illinois; and

 

WHEREAS, the Chicago Central & Pacific Railroad Company (CC&P), a subsidiary of Canadian National Railroad, owns and operates the railroad facilities at this location; and

 

WHEREAS, KDOT and CC&P have worked together to prepare a Grade Separation Agreement outlining the responsibilities of the parties for the construction of the roadway overpass at the railroad crossing along Randall Road as part of the Project; and

 

WHEREAS, the Agreement provides that CC&P will contribute five percent (5%) of the final cost of the Randall Road overpass due to the elimination of the existing at-grade crossing; and

 

WHEREAS, in order to construct and maintain the grade separation structure associated with the Project, the County must obtain a Permanent Easement Deed from CC&P over certain railroad right-of-way property within the Project limits; and

 

WHEREAS, the compensation for the Permanent Easement Deed is Fifty-Nine Thousand Five Hundred Dollars ($59,500.00); and

 

WHEREAS, funds for the Permanent Easement Deed are available within the Project budget.

 

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Grade Separation Agreement between the County of Kane and the Chicago Central & Pacific Railroad Company for the Randall Road at Hopps Road Intersection Improvement and Grade Separation Project, Kane County Section No. 19-00511-00-CH, is hereby approved.

 

 

BE IT FURTHER RESOLVED that the Permanent Easement Deed from the Chicago Central & Pacific Railroad Company granting a permanent easement to the County of Kane for the construction and maintenance of the grade separation structure associated with the Project is hereby approved.

 

BE IT FURTHER RESOLVED that the Kane County Board appropriate the not to exceed sum of Fifty-Nine Thousand Five Hundred Dollars ($59,500.00) from the Motor Fuel Tax Fund #302, Line Item #74010 (Highway Right-of-Way) to pay for the said Permanent Easement Deed required for the Project.

 

BE IT FURTHER RESOLVED that the Chairman of the Kane County Board is hereby authorized to execute the Grade Separation Agreement, Permanent Easement Deed, and any associated documents necessary therefor.
