Authorizing the 2024 Reprogramming of ARPA Lost Revenue Recoupment Funds as Reported to the US Department of Treasury in the Amount of $9,800 (Nine Thousand Eight Hundred Dollars) from the Kane County 16th Judicial Circuit Court Services’ Probation Victim Services & Alliance Against Intoxicated Motorists Projects to the Kane County Building Management Department’s Exterior Envelope Pipe Chase Improvement at the Kane County Jail ARPA Project

WHEREAS, the Congress of the United States has enacted the American Rescue Plan Act of 2021 (“ARPA”) to provide economic relief to State, Local, and Tribal governments responding to economic and public health impacts of the COVID-19 pandemic; and
WHEREAS, the County of Kane has received a total of $103,413,041 (One Hundred Three Million, Four Hundred Thirteen Thousand, Forty-One Dollars) from the United States Department of the Treasury, in State and Local Fiscal Recovery Funds (“SLFRF”) pursuant to ARPA; and
WHEREAS, pursuant to ARPA and the administrative regulations adopted by the United States Department of the Treasury (“Final Rule”), the County of Kane shall use SLFRF to defray costs associated with its response to the COVID-19 pandemic within the County, to address the economic fallout from the pandemic, and lay the foundation for a strong and equitable recovery; and
WHEREAS, by Resolution 21-313, the Kane County Board has established the American Rescue Plan Committee (“ARPC”) as a resource for research, education, planning, and recommendations for the best allocation and uses of the County’s SLFRF; and
WHEREAS, the Probation Victim Services Fund, was created as a special revenue fund to account for funds collected when a probation department assesses more than a $25/month probation fee to be used to support services in the community serving victims of crime; and the Victim Impact Panel Fund, was created as a special revenue fund to account for fees collected by Court Services to facilitate Victim Impact Panel presentations; and
WHEREAS, RES 21-385 authorized the allocation of recoupment of lost revenue under the American Rescue Plan Act (ARPA) in the amount $2,200 to the Probation Victim Services Fund project and $7,600 to the Alliance Against Intoxicated Motorists (Victim Impact Panel Fund) project; and
WHEREAS, the Probation Victim Services Fund Programs and the Victim Impact Panel Fund Programs have significantly been reduced in scope; and
WHEREAS, the ARPA Program recommends the reprogramming of the ARPA Lost Revenue Recoupment funds in the amount of $9,800 (Nine Thousand Eight Hundred Dollars) from the Kane County 16th Judicial Circuit Court Services’ Probation Victim Services Fund & Alliance Against Intoxicated Motorists (Victim Impact Panel Fund) projects to the Kane County Building Management Department’s Exterior Envelope Pipe Chase Improvement at The Kane County Jail ARPA project; and
WHEREAS, the ARP Committee recommends that the Kane County Board authorizes the reprogramming of the ARPA Lost Revenue Recoupment funds in the amount of $9,800 (Nine Thousand Eight Hundred Dollars) from the Kane County 16th Judicial Circuit Court Services’ Probation Victim Services Fund & Alliance Against Intoxicated Motorists (Victim Impact Panel Fund) projects to the Kane County Building Management Department’s Exterior Envelope Pipe Chase Improvement At The Kane County Jail ARPA project to be spent during the ARPA period of performance and in accordance with the American Rescue Plan Act of 2021, the Final Rule, and related guidance issued by the United States Department of the Treasury, and any other Federal, State or local laws and regulations.
NOW, THEREFORE, BE IT RESOLVED that the Kane County Board hereby authorizes the reprogramming of the ARPA Lost Revenue Recoupment funds in the amount of $9,800 (Nine Thousand Eight Hundred Dollars) from the Kane County 16th Judicial Circuit Court Services’ Probation Victim Services Fund & Alliance Against Intoxicated Motorists (Victim Impact Panel Fund) projects to the Kane County Building Management Department’s Exterior Envelope Pipe Chase Improvement at The Kane County Jail ARPA project to be spent during the ARPA period of performance and in accordance with the American Rescue Plan Act of 2021, the Final Rule, and related guidance issued by the United States Department of the Treasury, and any other Federal, State or local laws and regulations.
