Resolution Authorizing the Sale of a District Owned Parcel on Jericho Road at Big Rock Forest Preserve

WHEREAS, the Forest Preserve District of Kane County, Kane County, Illinois currently owns a parcel located on Jericho Road at the Big Rock Forest Preserve; and
WHEREAS, 70ILCS 805/6, authorizes the Forest Preserve District to purchase a parcel of land and to subsequently sell any one or more parcels that are less than one acre in size, pursuant to resolution of the Board of Commissioners passed by a two-thirds majority of the Board; and
WHEREAS, staff performed a site review of the District owned parcel, and determined it provided little habitat quality and limited to no public access or use potential; and
WHEREAS, the parcel is less than one acre; and
WHEREAS, the parcel is burdened by the following conditions: a home of historic significance to the community, substantial stabilization and remediation costs associated with its restoration, and inability to obtain a demolition permit from the County; and
WHEREAS, a restriction will be placed on the parcel requiring the preservation of the home; and
WHEREAS, the parcel was valued by and MAI appraisal at $65,000.00 and will be sold by public auction with notices mailed to nearby property owners and local historic preservation groups; and
WHEREAS, government agencies will be contacted first, prior to sale by auction, and offered a first right- of-refusal to maintain the land for public use; and
WHEREAS, the condition of the parcel, home, and site restrictions make the sale price to be obtained at auction uncertain, no reserve will be set at auction; and
WHEREAS, the board finds the sale without a reserve will be advantageous to the district.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Forest Preserve District of Kane County, Kane County, Illinois that the District be, and hereby is, authorized to sell the real estate described in Exhibit A, attached hereto, without reserve, under such terms and conditions as may be set forth in the sales contract.
