Resolution Approving an Intergovernmental Easement Agreement Between the Forest Preserve District of Kane County and the Fox Valley Park District

WHEREAS, The Forest Preserve District of Kane County (FPDKC) and the Fox Valley Park District (FVPD) desire to enter into an Intergovernmental Easement Agreement to allow for the construction and maintenance of a bike and pedestrian bridge across the Fox River in Batavia, connecting Lippold Park on the east and Les Arends Forest Preserve on the west; and
WHEREAS, the FPDKC is a forest preserve district, organized and existing under the laws of the State of Illinois and the Downstate Forest Preserve Act (70 ILCS 805/1 et.seq.); and
WHEREAS, the FVPD is a park district, organized and existing under the laws of the State of Illinois and the Park District Code (70 ILCS 1205/1-1 et.seq.); and
WHEREAS, the FPDKC and FVPD are authorized, pursuant to Illinois Compiled Statutes, Chapter 50, Section 605/0.01 et seq., to enter into intergovernmental agreements; and
WHEREAS, the FVPD has determined that a pedestrian bridge spanning the Fox River would be useful to its mission and residents of Kane County as an addition to the trails and facilities in the Les Arends Forest Preserve area; and
WHEREAS, FPDKC has determined that the use of the District’s property for this purpose and in this manner is consistent with FPDKC’s mission and with its policies of intergovernmental cooperation.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Forest Preserve District of Kane County, Kane County, Illinois, that the Intergovernmental Easement Agreement attached hereto and made part hereof is hereby approved and that the President and Secretary of the District, be, and hereby are, authorized to execute on behalf of the District.
