Approving Execution Authority for PY2025 and PY2026 External Amendments and Amendments to External Grand Victoria Casino Elgin Fund Projects in Subsequent Program Years

WHEREAS, the Kane County Board previously approved funding for external projects through the PY2025 Grand Victoria Casino Elgin Fund; and
WHEREAS, amendments to the funding agreements for certain PY2025 external Grand Victoria Casino Elgin Fund projects may be necessary to address changes to project scope, funding, schedules, or other terms of the agreements; and
WHEREAS, certain amendments to PY2025 external Grand Victoria Casino Elgin Fund project funding agreements have been executed by the Kane County Board Chairman and require ratification by the Kane County Board, as identified in the attached list; and
WHEREAS, additional amendments to PY2025 external Grand Victoria Casino Elgin Fund project funding agreements may be necessary and require authorization for execution by the Kane County Board Chairman; and
WHEREAS, similar amendments to external Grand Victoria Casino Elgin Fund project funding agreements may be necessary in subsequent Program Years and future resolutions approving funding agreements will provide for this process; and
WHEREAS, the Kane County Board desires to authorize the Kane County Board Chairman to execute amendments to approved external Grand Victoria Casino Elgin Fund project funding agreements subject to the review and advisement of the Kane County State’s Attorney’s Office, provided that such amendments do not increase the total amount of Grand Victoria Casino Elgin Fund funding previously approved by the Kane County Board.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the amendments to the PY2025 external Grand Victoria Casino Elgin Fund project funding agreements previously executed by the Kane County Board Chairman, as identified in the attached list, are hereby ratified and approved; and
BE IT FURTHER RESOLVED that the Kane County Board Chairman is hereby authorized to execute additional amendments to PY2025 and PY2026 external Grand Victoria Casino Elgin Fund project funding agreements, provided that such amendments do not increase the total amount of funding previously approved by the Kane County Board, subject to the review and advisement of the Kane County State’s Attorney’s Office; and
BE IT FURHTER RESOLVED that all such amendments shall be subject to review and approval by the appropriate Kane County departments and shall comply with all applicable County policies, funding requirements, and applicable federal, state, and local laws.
