Approving Execution of a Right of Way Acquisition Agreement Between the County of Kane and the Forest Preserve District of Kane County for the Fabyan Parkway at Kingsland Drive Improvement Project, Kane County Section No. 21-00373-01-CH

WHEREAS, the County of Kane is undertaking improvements to Fabyan Parkway at Kingsland Drive, Kane County Section No. 21-00373-01-CH (the "Project"); and
WHEREAS, completion of the Project requires the acquisition of permanent highway right of way and temporary construction easements from property owned by the Forest Preserve District of Kane County; and
WHEREAS, the County and the Forest Preserve District of Kane County have negotiated a Right of Way Acquisition Agreement providing for the conveyance of approximately 0.080 acres of permanent right of way together with temporary construction easements necessary for construction of the Project; and
WHEREAS, the Agreement provides for total consideration in the amount of Nineteen Thousand One Hundred Dollars ($19,100.00), consisting of Twelve Thousand Five Hundred Dollars ($12,500.00) for permanent right of way and Six Thousand Six Hundred Dollars ($6,600.00) for temporary construction easements; and
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County approves the acquisition of permanent right of way and temporary construction easements from the Forest Preserve District of Kane County for total consideration in the amount of Nineteen Thousand One Hundred Dollars ($19,100.00).
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that it hereby appropriates the sum of Nineteen Thousand One Hundred Dollars ($19,100.00) from Transportation Sales Tax Fund #305, Line Item #74010 (Highway Right of Way) for payment of said acquisition of permanent right of way and temporary construction easements from the Forest Preserve District of Kane County.
BE IT FURTHER RESOLVED by the Kane County Board that the County Engineer, Michael Zakosek, is hereby delegated authority to, and is authorized to execute the Right of Way Acquisition Agreement between the County of Kane and the Forest Preserve District of Kane County, together with any deeds, temporary construction easements, closing documents, and other documents necessary to complete the acquisition.
