Approving Amendment No. 2 to the Phase I Engineering Services Agreement with Alfred Benesch & Company of Chicago, Illinois for Randall Road Multi Modal Improvements, Kane County Section No. 21-00539-00-TD

WHEREAS, pursuant to Resolution No. 22-436, the County of Kane approved a Phase I Engineering Services Agreement (hereinafter the “Agreement”) with Alfred Benesch & Company and appropriated One Million Two Hundred Fifty-Two Thousand One Hundred Ten Dollars ($1,252,110.00), (hereinafter the “Appropriation”) for the improvement of North Randall Road Multi Modal Improvement (hereinafter the “Improvement”); and
WHEREAS, pursuant to Resolution No. 22-479, the County entered into Amendment No. 1 to the Agreement with Alfred Benesch & Company to amend the fund source to pay for the engineering services approved therein (hereinafter referred to as “Amendment No. 1”); and
WHEREAS, the term of the Agreement was for three and a half years and shall expire before completion of the previously approved Improvement; and
WHEREAS, there are funds available in the original Appropriation and Amendment No. 1 for the Improvement; and
WHEREAS, it is in the County’s best interest to enter into Amendment No. 2 to extend the date of the Agreement by three (3) years from the date of expiration from Kane County Resolution No. 22-436 (or June 30, 2028).
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Amendment No. 2 to the Agreement with Alfred Benesch & Company is hereby approved and that the Chairman thereof is hereby authorized and directed to execute the Amendment.
