WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that units of government may contract or otherwise associate among themselves to obtain or share services and to exercise, combine, or transfer any power of function in any manner not prohibited by law or by ordinance and may use their credit, revenues, and other resources to pay cost related to intergovernmental activities; and

 

WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. provides that any county may participate in an intergovernmental agreement under this Act notwithstanding the absence of specific authority under the State law to perform the service, provided that the unit of government contracting with the county has authority to perform the service; and

 

WHEREAS, counties are required to keep and maintain a jail facility in their county for its use, which may be satisfied by a single jail facility jointly used and maintained by two counties (730 ILCS 125/1); and

 

WHEREAS, Kane County finds that it is in its best interest to renew an intergovernmental agreement with Kendall County to obtain and provide available housing for their respective detainees as the need arises, with a per diem charge of Seventy-Eight Dollars ($78.00) per day per detainee; and

 

WHEREAS, this Agreement will renew with an effective date of December 1, 2026, for a term of three (3) years. A minimum of one (1) year prior written notice of early termination of the Agreement by the Housing Party to the Non-Housing Party’s Sheriff shall be required for the duration of the Agreement.

 

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof is hereby authorized and directed to renew the intergovernmental agreement with the County of Kendall for the reciprocal housing of detainees.
