Approving Kane County S.W.A.T. Team Intergovernmental Agreement for Tactical Emergency Medical Support Services with Pingree Grove Fire Department

WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, and the Intergovernmental Cooperation Act, 5 ILCSO 220/1, et seq., provide that units of local government may contract or otherwise associate among themselves to obtain or share services and do exercise, combine, or transfer any power or function in any matter not prohibited by law or by ordinance and may use their credit, revenues, and other resources to pay costs related to intergovernmental activities; and
WHEREAS, there exists in Kane County, under the operation of the Office of the Sheriff and with the participation of local law enforcement agencies, a Special Weapons and Tactics Team (“S.W.A.T.”) to provide tactical responses to critical incidents; and
WHEREAS, the S.W.A.T. team needs medical support services to respond to critical incidents and the Pingree Grove Fire Department is ready and willing to provide such Tactical Emergency Medical Support (“T.E.M.S.”); and
WHEREAS, in exchange for their T.E.M.S. services, the County agrees to indemnify the Pingree Grove Fire Department and its employees for loss or injury sustained during a S.W.A.T. operation and under the direction of S.W.A.T.
NOW, THEREFORE, BE IT RESOLVED that the Kane County Board authorizes and directs the Chair thereof to execute, on behalf of the County, an Intergovernmental Agreement for Tactical Emergency Medical Support Services with the Pingree Grove Fire Department.
