title

Authorizing an Intergovernmental Agreement with Ogle County for Juvenile Detention Services

body

WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that units of local government may contract or otherwise associate among themselves to obtain or share services and to exercise, combine, or transfer any power or function in any matter not prohibited by law or by ordinance and may use their credit, revenues, and other resources to pay costs related to intergovernmental activities; and

WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., provides that any county may participate in an intergovernmental agreement under this Act notwithstanding the absence of specific authority under the State law to perform the service involved provided that the unit of local government contracting with the county has authority to perform the service; and

WHEREAS, Ogle County has an existing intergovernmental agreement with Kane County wherein Kane County houses Ogle County minors at its Juvenile Justice Center.  That agreement expires on December 1, 2025, and Ogle County would like to enter into a new three-year agreement with Kane County to provide juvenile detention services.  The new three-year intergovernmental agreement increases the current per diem charge of $175.00 (one hundred and seventy-five dollars) per day per minor to $225.00 (two hundred and twenty-five dollars) per day per minor; and

WHEREAS, the intergovernmental agreement with Ogle County commences upon date of approval and signature by Ogle County and Kane County and will continue until December 1, 2028.  This agreement may be amended with the written consent of all parties hereto and, provided a need continues to exist and may be renewed thirty (30) days prior to the expiration date for a period not to exceed one (1) year for each renewal.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Madam Chair be authorized to sign a three-year contract with the County of Ogle for Juvenile Detention Services.
