Resolution Authorizing a License Renewal and Third Amendment with All Grass Farms, at the Brunner Family Forest Preserve

WHEREAS, the Forest Preserve District of Kane County and All Grass Farms entered into a license agreement in February of 2015 for the establishment of a regenerative farm operation at the Brunner Family Forest Preserve; and

 

WHEREAS, the agreement has been amended twice in the past including two previous five-year terms, expiring on December 31, 2024; and

 

WHEREAS, the license agreement includes renewal options for a total term of twenty-five (25) years and whereby, this amendment provides for the second renewal, calling for an extension of an additional three-year term expiring December 31, 2027; and

 

WHEREAS, additional modifications in this amendment include the modification of fee structure to include an additional $25,340 per year rent for use of the buildings, a reduction in revenue sharing to 1% of gross sales, additional restrictions for well and stream buffers, and permit requirements for the sale of raw milk.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Forest Preserve District of Kane County, Kane County, Illinois, that the Third Amendment to the License Agreement with All Grass Farms, which is attached hereto as Exhibit A, is hereby approved and that the President and Secretary of the Forest Preserve District of Kane County are hereby authorized and directed to execute said agreement on behalf of the District in accordance with its terms.
