Approving Amendment No. 2 to an Intergovernmental Agreement Between the County of Kane and City of St. Charles for Access and Improvements to Randall Road from IL Route 64 to Dean Street

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and the Intergovernmental Cooperation Act of the Illinois Compiled Statutes, 5 ILCS 220/1, et seq. authorizes the County of Kane (“County”) and the City of St. Charles (“St. Charles”) to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and
WHEREAS, pursuant to Kane County Resolution No. 06-407, the County and St. Charles entered into an intergovernmental agreement to allow access to Randall Road from between Illinois Route 64 and Dean Street and to thereafter provide for certain intersection improvements (hereinafter the “Agreement”); and
WHEREAS, pursuant to Kane County Resolution No. 18-163, the County and St. Charles entered into Amendment No. 1 to the Agreement to address the modification of the timing of payments from St. Charles to the County relative to said intersection improvements; and
WHEREAS, he County and St. Charles desire to amend the Agreement (hereinafter “Amendment No. 2”) (a copy of which is on file with the County Clerk’s Office) for a Right-In or Right-In/Right-Out only access to the south bound Randall Road for the purposes of future development of the adjacent property; and
WHEREAS, the County and St. Charles believe the proposed Amendment No. 2 to the Agreement provides a benefit for the citizens of St. Charles and the County, providing for the safety of the motoring public and enhancing the efficient movement of traffic in the area.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Amendment No. 2 to the Agreement for Access Improvements to Randall Road from Illinois Route 64 to Dean Street is hereby approved and that the County Board Chairman is hereby authorized and directed to execute Amendment No. 2 to the Agreement with the City of St. Charles.
