Authorizing an Intergovernmental Agreement Between LaSalle County, Illinois, and Kane County, Illinois, for the Housing of Detainees

WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that units of government may contract or otherwise associate among themselves to obtain or share services and to exercise, combine, or transfer any power of function in any manner not prohibited by law or by ordinance and may use their credit, revenues, and other resources to pay cost related to intergovernmental activities; and
WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. provides that any county may participate in an intergovernmental agreement under this Act notwithstanding the absence of specific authority under the State law to perform the service provided that the unit of government contracting with the county has authority to perform the service; and
WHEREAS, the Parties agree that it is in their best interest to enter into a contract to obtain and provide housing for detainees of the Kane County Sheriff’s Office at the LaSalle County Sheriff’s Corrections Department as the need arises at a per diem cost of Sixty-Five Dollars ($65) per detainee and for a maximum number of one hundred (100) individuals in custody (IICs); and
WHEREAS, the intergovernmental agreement with LaSalle County commences upon the date of approval and acceptance by all parties hereto and will continue in effect until terminated.
NOW, THEREFORE, BE IT RESOLVED that the Kane County Board that the Chairman thereof is hereby authorized and directed to enter into an agreement with the County of LaSalle for the housing of detainees.
